Terms of Service

1. Acceptance of Terms
By accessing the Recovery Plus website (myrecoveryplus.com), creating an account, booking an appointment, or receiving any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our website or services.
Recovery Plus reserves the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
2. Services
Recovery Plus provides localized cryotherapy, cryo facials, red light therapy, compression therapy, and related wellness services at our location inside Ace gym, 1276 Callen Street, Vacaville, CA 95688.
Our services are wellness treatments, not medical treatments. Recovery Plus does not diagnose, treat, cure, or prevent any disease or medical condition. Our services are intended to complement, not replace, professional medical care. Consult your physician before beginning any new wellness regimen.
3. Eligibility
- You must be at least 18 years of age to book and receive services independently.
- Minors ages 14–17 may receive treatment only with a parent or legal guardian physically present who has signed all required intake and consent forms.
- Children under 14 are not eligible for cryotherapy services.
- You must complete our health intake form honestly and completely before your first session. Failure to disclose relevant health conditions may result in denial of service and releases Recovery Plus from liability.
4. Health Screening & Contraindications
Cryotherapy is contraindicated for individuals with certain conditions including but not limited to:
- Uncontrolled hypertension or severe cardiovascular disease
- Cold allergy (cold urticaria) or Raynaud’s disease (severe)
- Deep vein thrombosis or blood clotting disorders
- Pregnancy
- Seizure disorders
- Open wounds or acute infections at the treatment site
- Peripheral neuropathy or nerve disorders
- Recent heart attack or stroke (within 6 months)
You are responsible for disclosing all relevant medical conditions on your intake form. Recovery Plus staff may refuse service if they believe treatment poses a health risk. This is not a medical determination and does not substitute for professional medical advice.
5. Booking & Appointments
5.1 Scheduling
- Appointments can be booked online at myrecoveryplus.com or in person at our Vacaville location.
- Walk-in appointments are accepted subject to availability.
- Same-day bookings are available.
- All appointment times are in Pacific Time (PT).
- If you begin a booking but do not complete it, your selected service and form data may be saved in your browser’s local storage so you can resume later. This data is stored only on your device.
5.2 Cancellations
- 12+ hours before appointment: Full refund or no charge.
- 2–12 hours before appointment: 50% cancellation fee applies.
- Less than 2 hours / No-show: Full session rate charged.

5.3 Late Arrivals
If you arrive more than 10 minutes late, your session may be shortened or rescheduled at our discretion. The full session rate still applies.
5.4 Check-In
Upon arrival, you may check in using our self-service kiosk or with staff assistance. Check-in confirms your arrival and updates your booking status. If you do not check in by your appointment time, you may be marked as a no-show.
6. Pricing & Payment
6.1 General
- All prices are listed in U.S. dollars and are subject to change without prior notice.
- Payment is required at the time of booking unless otherwise specified (e.g., package or subscription).
- We accept major credit and debit cards processed through Stripe and Square.
- HSA and FSA cards are accepted.
- Your payment method information is securely processed by our payment providers. We store only a payment gateway reference ID for transaction management and do not store full card numbers.
6.2 Session Packages
- Session packages (4-pack, 8-pack, 12-pack, 16-pack) are valid for 12 months from the date of purchase.
- Packages are non-transferable unless expressly permitted.
- Expired unused sessions are forfeited and non-refundable.
- Your remaining session balance is visible in your online account.
6.3 Monthly Subscriptions
- Subscriptions (Bronze, Silver, Gold) are billed automatically on a recurring monthly basis via Stripe.
- You may cancel your subscription with 30 days’ written notice. Cancellation takes effect at the end of the current billing period.
- Unused monthly sessions do not roll over to the following month.
- Subscription benefits (priority booking, add-ons) are active only during an active subscription period.
- If a recurring payment fails, we will retry up to 3 times. If all retries fail, your subscription may be suspended until payment is resolved.
- Trial periods, if offered, are specified at the time of enrollment. After the trial period ends, your card will be charged the regular subscription rate automatically.
- You may pause your subscription by contacting us. Paused subscriptions resume automatically after the agreed pause period.
6.4 Store Credits
- Store credits may be issued for refunds, referral bonuses, or promotional offers.
- Store credits are automatically applied to your next booking.
- Store credits have no cash value and cannot be transferred to another person.
- Your store credit balance is visible in your online account.
6.5 Gift Cards
- Gift cards do not expire and have no service fees, in accordance with California law (Civil Code § 1749.5).
- Gift cards are redeemable for any Recovery Plus service.
- Gift cards cannot be redeemed for cash except as required by law (balances under in California).
- Gift cards can be delivered via email, SMS, in-person, or shareable link.
- Lost or stolen gift cards may be replaced if original purchase can be verified. Recovery Plus is not responsible for unauthorized use of gift card codes.
6.6 Promotional Codes
- Promotional codes are subject to specific terms stated at the time of offer.
- Codes cannot be combined with other offers unless explicitly stated.
- Recovery Plus reserves the right to modify or cancel promotions at any time.
7. Refund Policy
- Individual Sessions: Refundable if cancelled 12+ hours in advance. No refund for late cancellations or no-shows.
- Session Packages: Unused sessions may be refunded within 30 days of purchase at the difference between package price paid and individual session rate for sessions used. After 30 days, no refunds on packages.
- Subscriptions: No refunds for the current billing period. Prorated refunds may be issued for the remaining period if cancelled within 5 days of billing (cooling-off period).
- Gift Cards: Non-refundable. Cash back for balances under per California law.
- Store Credits: Non-refundable and non-transferable.
Refunds are processed to the original payment method within 5–10 business days. Store credit may be offered as an alternative at your request.
8. Rewards & Referral Program
8.1 Rewards Program
- The Recovery Plus Rewards Program is offered at our discretion and may be modified or discontinued at any time with 30 days’ notice to active members.
- Store credits earned through rewards have no cash value and cannot be transferred or sold.
- Recovery Plus reserves the right to adjust credit balances in cases of error or abuse.
8.2 Referral Program
- Referring clients may earn store credit or discounts when their referral code is used by a new client who completes a booking.
- Referral activity is tracked via unique referral codes and tracking links. When someone clicks your referral link, a cookie is stored on their device for 30 days to attribute their booking to you.
- Self-referrals and fraudulent referral activity (e.g., creating fake accounts) are prohibited and will result in forfeiture of all referral credits and possible account suspension.
- Referral bonuses are subject to change and may be modified or discontinued at any time.
9. Reviews & User Content
- You may submit reviews of our services after completing a booking. Reviews are linked to your verified booking to confirm you received the service.
- By submitting a review, you grant Recovery Plus a non-exclusive, royalty-free, perpetual license to display your review (including your first name, last initial, and role/title if provided) on our website and marketing materials.
- Reviews are subject to moderation. We reserve the right to reject or remove reviews that contain profanity, personal attacks, false claims, spam, or content unrelated to our services.
- Staff may respond to your review publicly. You will not be contacted privately about negative reviews.
- You may request removal of your review at any time by contacting us.
10. Group Events & Freeze Parties
- Group event bookings (freeze parties, corporate events) are arranged through our event request form or by contacting us directly.
- Event pricing starts at /person for groups of 10 or more. Final pricing is confirmed in writing before the event.
- A deposit may be required to secure your event date. Deposit terms will be specified in your event confirmation.
- Cancellation of group events must be made at least 72 hours in advance for a full deposit refund. Cancellations within 72 hours may forfeit the deposit.
- All event participants must complete individual intake forms and meet eligibility requirements before receiving treatment.
11. Assumption of Risk & Waiver
Cryotherapy involves exposure to extremely cold temperatures (-110°F / -79°C and below). By using our services, you acknowledge and accept the following risks:
- Skin redness, irritation, or temporary numbness at the treatment site.
- In rare cases: frostbite, cold burns, or allergic reaction to cold exposure.
- Lightheadedness, dizziness, or fainting during or after treatment.
- Aggravation of pre-existing conditions not disclosed on your intake form.
You voluntarily assume all risks associated with cryotherapy and related treatments. You agree to follow all instructions provided by Recovery Plus staff during your session.
12. Limitation of Liability
To the fullest extent permitted by California law:
- Recovery Plus, its owner, employees, and independent contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.
- Our total aggregate liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.
- This limitation applies regardless of whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Recovery Plus, its owner Brian McClellin, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from:
- Your use of our services.
- Your violation of these Terms.
- Your failure to disclose accurate health information on your intake form.
- Your violation of any third party’s rights.
14. Intellectual Property
All content on the Recovery Plus website — including text, graphics, logos, images, and software — is the property of Recovery Plus or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.
15. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- If you book using an email address associated with an existing WordPress account on our site, your booking history may be automatically linked to that account.
- Notify us immediately at Brian.recoveryplus@outlook.com if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
16. Data & Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Key points:
- You may request export or deletion of your personal data at any time.
- Financial records are retained for 7 years per legal requirements, even after data deletion requests.
- Personal information on old bookings is automatically anonymized after 2 years.
- We do not sell your personal information to third parties.
17. Prohibited Conduct
When using our website or services, you agree not to:
- Provide false information on intake forms or during booking.
- Use our services while under the influence of alcohol or drugs.
- Harass, threaten, or abuse Recovery Plus staff or other clients.
- Attempt to manipulate our booking system, rewards program, referral program, or promotional offers.
- Create multiple accounts to exploit promotional offers or referral bonuses.
- Use automated tools to scrape, crawl, or access our website.
- Submit fraudulent reviews or impersonate another person in a review.
Violation of these rules may result in immediate termination of service, account suspension, and forfeiture of store credits and package balances.
18. Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of California.
- Informal Resolution: Before filing any formal action, you agree to contact us at Brian.recoveryplus@outlook.com to attempt to resolve the dispute informally within 30 days.
- Jurisdiction: Any legal action arising from these Terms shall be filed exclusively in the state or federal courts located in Solano County, California.
- Small Claims: Either party may bring qualifying claims in small claims court in Solano County.
19. Force Majeure
Recovery Plus shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, power outages, government orders, or facility closures by Ace gym.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy and any signed intake/consent forms, constitute the entire agreement between you and Recovery Plus regarding your use of our services.
